Information for the Accused
The college will conduct impartial and thorough investigations of allegations of potential Title IX and Discriminatory Harassment and Sexual Misconduct (DHSM) policy violations, and will objectively adjudicate disciplinary proceedings. All reports of potential violations will be investigated, regardless of the source, although the information available may affect the type of investigation that can be done. A report may be made with the Portland Police Bureau by the complainant or by the college if the alleged violation of the DHSM may also be criminal behavior.
This Options and Resources for Student Respondents handbook is intended to provide information to students accused of Title IX violations, including those who are respondents in Title IX cases.
Julie Maxfield, Associate Dean of Students for Academic Life provides information and academic support to those accused of sexual assault, relationship abuse, and stalking. Students may also receive emotional support from health & counseling services.
Title IX Investigation
Reports of sexual misconduct are made to the Title IX Coordinator or their designee. The results of a Title IX investigation are a finding of fact and a determination of whether or not Title IX was violated, and may be appealed. Because the findings become part of any future disciplinary proceedings and may be subpoenable, the respondent may wish to seek legal counsel. Please see the Title IX page for more information about the process.
If the accused is a current or former student, the reporting party may choose to bring a complaint to the Title IX Board (TNB) alleging violation of the DHSM (in some cases the college may act as complainant). Although attorneys are not allowed to speak in TNB hearings, the respondent may wish to seek legal counsel before submitting written or verbal testimony. The respondent has the right to name witnesses to be contacted by the TNB. Based on all testimony and supporting documents (which includes documentation from any related Title IX investigation), the TNB decides on the facts of the case, determines if a violation of the DHSM occurred, and if so, recommends sanctions. Complaints are received by the Director of Human Resources and handled according to the human resources formal complaint procedures for staff.
